When serving documents overseas, how long has the agent got to serve it and who swears the document? PDF Print

The agent has 42 days to serve the document. Once the document has been served, the agent will engage a Notary Public in their state, town or city to swear the document in.

Once the process server or investigator has served the document he/she will advise you that the documents have been served. The agent will send you the original Affidavit of Service to your premises and may also fax you a copy of the Affidavit. Upon recieving the Affidavit of Service or Acknowlegment of Service you will take it to the police station to witness their signature on the Proof of Signature form, and then file the document in the appropriate court.
