If the spouse refuses to sign the Acknowledgment of Service, the process server can leave the documents in his/her presence by laying them next to the door or at their feet.

The agent will fill out the Affidavit of Service form under "attempted service", and state that the spouse refused to sign the document after he/she answered "yes" to their identity. The form will state that the documents were left in their presence. The Acknowledgement of Service is no longer required as the Affidavit of Attempted Service can be filed instead.
