When serving a Magistrates' Court summons for debt, who can accept it if the defendant is not home? PDF Print

Any person who is over the age of 16 can accept a document for service.

When the process server affects service at the defendant's residence and the defendant is not home, he/she will ask the person at the premises if the defendant is there. If that person advises that the defendant resides at the premises, but is not home, the agent will ask that person if they are over 16 years of age.

If the person ackowledges that they are over the age of 16, service has been affected at that address.
